General Terms and Conditions for Chefs
PeopleEat UG, business address: Montgolfier-Allee 24, 60486 Frankfurt am Main, represented by managing director Daniel Merkel (hereinafter “PeopleEat”) operates under the website https://www.people-eat.com/ an internet platform (hereinafter “internet platform”) for the mediation of exclusive home cooking events (hereinafter “cooking events”) by independent professional and amateur chefs (hereinafter “chefs”) in premises provided by the customer.
1. Definitions
1.1. “Chefs” are entrepreneurs within the meaning of Section 14 BGB who, in a commercial or independent capacity, offer exclusive cooking events and commission PeopleEat to mediate the services they offer on the internet platform to customers (hereinafter “customer”).
1.2. “Customers” are consumers within the meaning of Section 13 BGB as well as entrepreneurs within the meaning of Section 14 BGB who have the cooking events offered by the chefs mediated via the internet platform.
1.3. “Platform user” is any chef or customer who uses PeopleEat’s platform for the mediation of exclusive home cooking events.
1.4. “Cooking events” are the services offered by the chefs on the internet platform for the preparation of menus in the context of exclusive home cooking events that are booked by customers and performed at the customers’ premises.
2. Scope of the general terms and conditions
2.1. These general terms and conditions (hereinafter “GTC”) govern the rights and obligations of the chef and PeopleEat when using the services on the internet platform. Deviating general terms and conditions of the chef are not accepted.
2.2. Unless otherwise agreed, the GTC valid at the time of registration as a chef on the internet platform continue to apply to the chef until the chef has agreed to any amended GTC.
3. Subject matter of the contract
3.1. PeopleEat offers a platform for mediating cooking events on the website https://www.people-eat.com/, on which platform users can offer and book services. PeopleEat acts as intermediary for the contracts concluded between the chef and the customer (hereinafter “cooking event contracts”). PeopleEat handles the commercial processing of the cooking event contracts. Commissioning PeopleEat does not create a contract for the performance of cooking events with PeopleEat or on behalf of PeopleEat with the customer. Between the customer and PeopleEat there is exclusively a mediation contract.
3.2. The customer entrusts PeopleEat with the mediation of cooking event contracts for the cooking events offered by the chefs on the internet platform. The cooking event contracts mediated by PeopleEat are concluded exclusively between the customer and the chef. Any rights and obligations arising from the cooking event contracts exist only between the respective customer and the chef. Claims, in particular claims for damages arising from the breach of contractual or collateral contractual obligations in connection with the chefs’ cooking event contracts, do not exist against PeopleEat. The relationship between PeopleEat and the customer is also not a contract for the benefit of third parties or with protective effect for third parties.
4. Registration / conclusion of the service contract
4.1. By registering as a chef with first and last name, postal code/city, telephone number and email address on the internet platform, the chef submits a binding offer to PeopleEat to conclude a service contract. Only persons with full legal capacity are entitled to register. PeopleEat may accept or reject the offer within 14 days at its free discretion. Acceptance by PeopleEat takes place by activating the chef’s profile, of which the chef is notified by PeopleEat by email.
4.2. The chef’s profile is not transferable. Claims and rights arising from the service contract with PeopleEat cannot be assigned.
4.3. Use of the internet platform is subject to a service fee of 18% of the menu price payable to PeopleEat. The chef sets the menu price at their own discretion. PeopleEat does not influence the pricing of menu offers. Travel costs are charged in addition to the menu price and result automatically from the travel cost price per km set by the chef and the distance between the chef’s address and the cooking event address. The service fee relates exclusively to the menu price.
4.4. In addition to the chef’s service fee named in section 4.3, PeopleEat charges the customer a service fee of 4% of the menu price. This is disclosed transparently to the customer before the booking is completed. Any fees of the payment service provider are borne additionally by the customer.
4.5. The chef undertakes towards PeopleEat, when fulfilling cooking event contracts with customers, always to act professionally, politely and in a customer- and service-oriented manner and to maintain quality standards of a good gastronomy and service experience, in particular to inquire about food intolerances, preparation preferences (vegan, vegetarian, halal, kosher, etc.) and allergies of customers and to take them into account independently at the cooking event, to declare goods and additives subject to labeling requirements completely and truthfully, to observe best-before dates when purchasing and using food, to maintain hygiene standards and to leave the customer’s kitchen clean.
4.6. The chef is aware that their activity may be regarded as commercial in nature and scope and may require corresponding public-law permits. The chef is aware that remuneration for services rendered under the cooking event contract must be taxed as income. The chef is solely responsible for the proper tax, insurance or social security treatment of the income.
4.7. The chef’s profile may be terminated at any time without notice periods. Termination must be sent in text form to contact@people-eat.com. The chef’s data will be deleted upon deactivation of the profile.
4.8. Changes to the profile must be made without delay. The chef is encouraged to upload an appealing profile picture while independently observing applicable law in order to increase the booking rate in their own interest. Any form of product placement is prohibited. The profile picture may exclusively depict the chef and no other persons. PeopleEat has the exclusive and free right of use to all media, in particular images (e.g. of dishes), films (clips) and texts (e.g. recipes, descriptions), published by chefs on the internet platform. Use of these media without the express consent of PeopleEat is not permitted. The chef agrees that media uploaded by them may be used by PeopleEat for advertising purposes and on social media. The chef guarantees that media uploaded by them to the internet platform do not infringe third-party rights and indemnifies PeopleEat against any damages arising from or in connection with the publication of media by the chef on the internet platform.
5. Booking / conclusion of the mediation contract
5.1. Use of the internet platform by customers requires registration of the customer. The customer may use the mediation services via the internet platform by completing a booking form. By entering the data requested in the booking form, the customer provides PeopleEat with personal data, including payment information for processing the booking (see privacy policy).
5.2. Bookings may only be made by persons with full legal capacity.
5.3. The data requested by PeopleEat during booking must be provided completely and truthfully. If the data provided changes after the booking is completed, the customer is obliged to notify PeopleEat of the changes without delay.
5.4. The customer may submit a non-binding request via the internet platform. Based on the request, the chef creates an individual offer and transmits it to the customer via the platform. The mediation contract between the customer and PeopleEat is concluded when the customer accepts the chef’s offer by clicking “Accept offer”. PeopleEat confirms the conclusion of the contract to the customer without delay by email. There is no entitlement to conclude a mediation contract.
6. Mediation / conclusion of the cooking event contract between customer and chef
6.1. Via the internet platform, the chef offers cooking events with specific menu suggestions and information on the geographic radius in which they provide their services on a non-binding basis.
6.2. The customer submits a non-binding request via the internet platform without directing it to a specific chef. PeopleEat confirms receipt of the request to the customer without delay by email. Chefs who can fulfill the request are notified via the platform and have the opportunity to create an individual offer for the customer. A cooking event contract is not yet concluded thereby. The cooking event contract between the customer and the chef is concluded when the customer accepts the chef’s offer by clicking “Accept offer”. PeopleEat notifies the chef of this without delay by email.
6.3. PeopleEat is neither entitled nor obliged by a cooking event contract concluded between the customer and the chef. The chefs perform the cooking event contracts concluded with the customer independently and on their own responsibility. PeopleEat is not liable for the performance and fulfillment of the cooking event contracts. In particular, PeopleEat is not liable for health damage of any kind arising in connection with the performance of the cooking events.
7. Further obligations of PeopleEat
7.1. PeopleEat is obliged to operate the platform, forward incoming customer requests to the chefs and communicate customers’ offer acceptances to the respective chefs without delay. PeopleEat handles communication between customers and chefs and, in the event of complaints, attempts to mediate between the parties to the cooking event contracts without being obliged to do so. PeopleEat reserves the right not to forward customer requests to chefs.
7.2. PeopleEat processes cancellations by the customer as well as by the chef and notifies the respective parties to the cooking event contract of this without delay by email.
7.3. PeopleEat endeavors to enable the highest possible availability of the internet platform. However, it cannot be ruled out that the website may be temporarily unavailable, in particular in connection with technical adjustments or failure of data centers and redundancy systems.
7.4. Platform users have no claim that the platform is permanently and unchanged available.
8. Payment processing / cancellation
8.1. All payments from the customer to the chef for remuneration under the cooking event contracts are made via PeopleEat’s payment service provider. In the course of the booking or purchase process, the customer pays for the booked cooking event in advance to PeopleEat’s payment service provider.
8.2. Payment processing is carried out in cooperation with Stripe Payments Europe, Ltd., c/o A&L Goodbody, IFSC, North Wall Quay, Dublin 1, Ireland (hereinafter “Stripe”), subject to the Stripe terms of use, to which the chef assigns their payment claim. Stripe collects the outstanding amounts from the customer’s designated account. Payout to the chef takes place no earlier than 48 hours after completion of the cooking event. Until that time, the collected amount remains in trust with Stripe. If a complaint from the customer is received within the complaint period pursuant to section 8.9, PeopleEat may continue to withhold the payout until final clarification. After expiry of the period, the collected order value less the service fee is credited to a Stripe account of the chef. The chef’s service fee pursuant to section 4.3 and the customer’s service fee pursuant to section 4.4 are credited separately to a Stripe account of PeopleEat.
8.3. If change requests regarding the menu offering arise from the customer in the course of booking or contract performance, the chef undertakes to inform PeopleEat without delay of the type and scope of the changes. If a cooking event includes additional services not booked via the internet platform, the type, scope and amount of remuneration must be communicated to PeopleEat without delay. Any additional costs arising from additional services by the chef are to be borne by the customer and processed through subsequent adjustment of the order by the chef via PeopleEat. The service fee payable to PeopleEat must subsequently be calculated taking the additional service into account, and any shortfall must be settled by the chef without delay.
8.4. Cancellation by the customer. The customer may cancel booked cooking events free of charge up to 10 days before the start of the cooking event. In this case, the customer receives a full refund pursuant to section 8.7. Cancellation less than 10 days before the start of the cooking event is no longer free of charge; in this case the chef is entitled to the agreed remuneration in full and the customer receives no refund. Cancellation must be made by email to contact@people-eat.com or via the platform.
8.5. Cancellation within the grace period. Deviating from section 8.4, the customer may cancel the booked cooking event free of charge without stating reasons within 20 minutes after completing the booking (grace period). Cancellation must be made within this period by email to contact@people-eat.com or via the platform. In the event of timely cancellation, the customer receives a full refund pursuant to section 8.7.
8.6. Cancellation in cases of force majeure. In the event of force majeure or unforeseen circumstances for which the customer is not responsible, PeopleEat may at its own discretion grant a full or partial refund or issue a voucher, even if the requirements for a free cancellation pursuant to section 8.4 are not met. Such circumstances include in particular serious illness, death of close relatives, official orders or comparable events. Recognition requires suitable proof (e.g. medical certificate, death certificate, official letter). PeopleEat’s decision is made on a case-by-case basis and at its equitable discretion.
8.7. Refund process. Insofar as the customer is entitled to a refund under these GTC, it comprises the full amount paid by the customer, including the menu price, the service fee pursuant to section 4.4 and any fees of the payment service provider. The refund is made as quickly as possible, no later than within 14 days after confirmation of the cancellation, exclusively to the means of payment used by the customer for the booking.
8.8. Cancellation by the chef. The chef is obliged to notify PeopleEat without delay by email to contact@people-eat.com of any necessary cancellation of an already accepted cooking event contract. PeopleEat will endeavor where possible to mediate a replacement chef. If no replacement chef can be mediated or the customer rejects them, the customer receives a full refund pursuant to section 8.7. PeopleEat reserves the right, in the event of repeated or abusive cancellation by the same chef, to temporarily or permanently block the chef’s profile (see section 11).
8.9. Complaints and dispute resolution. The customer is obliged to report complaints about the performance of the cooking event contract within 48 hours after completion of the cooking event by email to contact@people-eat.com and to substantiate them with suitable documentation (e.g. photos, written correspondence). After expiry of this period, assertion of complaints against PeopleEat with regard to the funds held in trust is excluded. PeopleEat reviews incoming complaints and may at its equitable discretion order a full or partial refund, issue a voucher or release payment to the chef. This decision is binding on customer and chef with regard to the funds held in trust by PeopleEat. Any further claims between customer and chef remain unaffected.
9. Customer protection
9.1. If the chef offers the customer further cooking events for booking outside PeopleEat within 18 months after completion of a cooking event mediated via the internet platform, this constitutes a breach of duty by the chef towards PeopleEat.
9.2. If the chef is requested within this period by a customer directly — i.e. outside the internet platform — for a further cooking event, the chef is obliged to expressly point out to the customer that the booking must be made via PeopleEat and to refer the request accordingly to the platform.
9.3. If the chef breaches section 9.1 or 9.2, PeopleEat is entitled to temporarily or permanently block the chef’s profile (see section 11). No additional contractual penalty or commission claim will be asserted.
10. Liability
10.1. PeopleEat assumes no liability or guarantees in connection with the performance of the cooking event contract between the chef and the customer. Liability rests solely with the chef. This applies in particular to damage to customers in connection with the performance of the cooking events including the food prepared by the chef and consumed by the customer.
10.2. PeopleEat is liable to the platform user for damage arising from injury to body or health as well as damage based on an intentional or grossly negligent breach of duty by PeopleEat or one of its legal representatives without limitation in accordance with statutory provisions.
10.3. In all other cases, PeopleEat is liable only for culpable breach of essential contractual obligations whose fulfillment is necessary to achieve the purpose of the contract, and only for typical, foreseeable damage.
11. Exclusion of platform users
PeopleEat reserves the right to deny individual platform users access to the internet platform temporarily or permanently. PeopleEat will make use of this right in particular in cases of (suspected) abusive use of the internet platform.
12. Applicable law / place of jurisdiction
12.1. For all relationships between platform users arising in connection with the use of the internet platform and the mediation contracts by PeopleEat, the law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
12.2. If the customer is a consumer with habitual residence in the EU, they also enjoy the protection of the mandatory provisions of the law of their country of residence.
12.3. The place of jurisdiction for all disputes arising from or on the basis of the contractual relationship between PeopleEat and a platform user is, if the latter is an entrepreneur, the registered office of PeopleEat. PeopleEat may, however, alternatively sue the platform user at their general place of jurisdiction.

5. Terms and conditions for gift vouchers
5.1. Validity period of vouchers: Gift vouchers have a validity period of three years from the time of purchase. After expiry of this period, the vouchers lose their validity.
5.2. Redemption conditions: Gift vouchers can only be redeemed online at https://www.people-eat.com/. A PeopleEat account is required for redemption. The credit can only be redeemed for services offered via this platform. With each booking made with a gift voucher, the corresponding credit value is reduced. Remaining credit remains on the host account. If a payment exceeds the existing credit, the remaining amount must be settled using one of the payment methods offered.
5.3. Terms of use: The gift voucher can only be redeemed once per order. This means that only one gift voucher can be used for each transaction on the platform. It is not possible to have the value of the gift voucher paid out in cash. The voucher value can only be used to purchase services offered via this platform. Gift vouchers have a validity period of three years from the time of purchase. After expiry of this period, the vouchers lose their validity.
5.4. Limitation of liability and warranty: PeopleEat assumes no liability for loss or theft of gift vouchers. These should generally be treated like cash and will not be replaced in the event of loss. In the event of disputes, the Local Court of Frankfurt am Main has jurisdiction.
6. Mediation / conclusion of the cooking event contract between customer and chef
6.1. Via the internet platform, the chef offers cooking events with specific menu suggestions and information on the geographic radius in which they provide their services on a non-binding basis.

7.2. PeopleEat processes cancellations by the customer as well as by the chef and notifies the respective parties to the cooking event contract of this without delay by email.
7.3. PeopleEat endeavors to enable the highest possible availability of the internet platform. However, it cannot be ruled out that the website may be temporarily unavailable, in particular in connection with technical adjustments or failure of data centers and redundancy systems.
7.4. Platform users have no claim that the platform is permanently and unchanged available.
8. Obligations of customers
8.1. In order to use PeopleEat’s mediation services, the customer transmits the following data in the course of a booking:
First and last name of the customer
Billing address
Event address (if different from billing address)
Telephone number
Email address
8.2. The customer informs PeopleEat of short-notice cancellations regarding already booked cooking events by contacting PeopleEat via email at contact@people-eat.com so that PeopleEat can promptly notify the chef. PeopleEat does not guarantee timely forwarding to the chefs.
9. Payment processing / cancellation
9.1. PeopleEat’s mediation service is associated with a service fee of 4% of the menu price for the customer. The service fee is disclosed transparently to the customer before the booking is completed. Any fees of the payment service provider are borne additionally by the customer.
9.2. All payments from the customer to the chef for remuneration under the cooking event contracts are made via PeopleEat’s payment service provider. In the course of the booking or purchase process, the customer pays for the booked cooking event in advance to PeopleEat’s payment service provider.
9.3. 10. Booking via the platform
10.1. Bookings of cooking events between customer and chef should take place exclusively via the internet platform. If the customer approaches a chef directly whom they met through PeopleEat, the chef will refer them to booking via PeopleEat.
11. Liability
11.1. PeopleEat assumes no liability or guarantees in connection with the performance of the cooking event contract between the chef and the customer. Liability rests solely with the chef. This applies in particular to damage to customers in connection with the performance of the cooking events including the food prepared by the chef and consumed by the customer.
11.2. PeopleEat is liable to the platform user for damage arising from injury to body or health as well as damage based on an intentional or grossly negligent breach of duty by PeopleEat or one of its legal representatives without limitation in accordance with statutory provisions.
11.3. In all other cases, PeopleEat is liable only for culpable breach of essential contractual obligations whose fulfillment is necessary to achieve the purpose of the contract, and only for typical, foreseeable damage.
12. Exclusion of platform users
PeopleEat reserves the right to deny individual platform users access to the internet platform temporarily or permanently. PeopleEat will make use of this right in particular in cases of (suspected) abusive use of the internet platform.
13. Applicable law / place of jurisdiction
13.1. For all relationships between platform users arising in connection with the use of the internet platform and the mediation contracts by PeopleEat, the law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
13.2. If the customer is a consumer with habitual residence in the EU, they also enjoy the protection of the mandatory provisions of the law of their country of residence.
13.3. The place of jurisdiction for all disputes arising from or on the basis of the contractual relationship between PeopleEat and a platform user is, if the latter is an entrepreneur, the registered office of PeopleEat. PeopleEat may, however, alternatively sue the platform user at their general place of jurisdiction.
